Aeroplan Member Donation Program

General Terms and Conditions

 

In order to access and/or use this Website, you must comply with the terms and conditions herein (to the extent they are applicable to you) as well as the Aeroplan Rules.  In order for the charity/charitable initiative to be considered and approved for a member donation account and/or to participate in the Aeroplan member donation program, on behalf of such charity or charitable initiative, Aeroplan Applicant must comply (and where an Account Administrator has been designated by the Aeroplan Applicant, the Aeroplan Applicant must cause the Account Administrator to comply) with the terms and conditions herein as well as the Aeroplan Rules (defined below).  Please note that any conflict between the Aeroplan Rules and the Charity Rules (defined below) shall be resolved in favor of the Charity Rules.

Aimia Canada Inc. (“Aeroplan”) may in their sole discretion change, supplement, amend, suspend or terminate the member donation program and/or its terms and conditions from time to time, effective immediately, by posting revised terms and conditions on the website http://beyondmiles.aeroplan.com/eng/terms-of-use  (“Website”). It is your responsibility to check and review the terms and conditions periodically to ensure that you are familiar with the most current version and Aeroplan is under no obligation to provide further notice of any changes.  By accessing and/or using this Website and if applicable, your member donation account, after revised terms and conditions have been posted on the Website; you signify your acceptance and agreement, without limitation or qualification, to be bound by the revised terms and conditions. 

 

1.       Definitions:

 

a.       Account” means a member donation program account where the holder of the account is the applicable charity or charitable initiative.

 

b.       Account Administrator” means an individual designated by the Aeroplan Applicant to manage the applicable Account on behalf of the charity/charitable initiative.

 

c.       Aeroplan Applicant” means the Aeroplan member who applied for the creation of the Account and is responsible for the Account on behalf of the charity/charitable initiative.

 

d.       Aeroplan Rules” means the terms and conditions governing the Aeroplan Program including but not limited to the program’s General Terms and Conditions, Flight Reward Booking Rules, Website Usage and Privacy Policy located at http://www1.aeroplan.com/PrivacyPolicy.do.  For a full list of terms and conditions please visit http://www2.aeroplan.com/terms_and_conditions.do

 

e.       Member donation Program’s goals” means supporting organizations and individuals who want to improve lives and support communities.. In some cases, community members may use this pooling option to help an individual in dire need of assistance for medical purposes or a family emergency. 

 

f.       Charity Rules” means the terms and conditions of the Member donation program as set out herein.

 

g.       Member” means a member of the Aeroplan Program.

 

h.       Targeted Goal” means the number of Miles a charity/charitable initiative establishes as a target goal for a given length of time 3 months, 6 months or a year.

 

  1.  You” means a user and/or Member who accesses or uses this Website or the account.  For voidance of doubt, “you” shall include the Account Administrator and the Aeroplan Applicant.

 

2.       Eligibility:

 

a.       All applications must be made by an Aeroplan Member in good standing.

b.      A Member can either be an Aeroplan Applicant or an Aeroplan Administrator for only one charity/charitable initiative during a one year period.

c.       At the time of application, the Aeroplan Applicant must be a Canadian resident, whose Aeroplan profile indicates that s/he has attained the age of majority under the laws of the province in which s/he resides.

d.       All applications and charities/charitable initiatives must be based on and support the Member donation program Goals.  Aeroplan reserves the right to audit and/or require supporting documentation with respect to the charity/charitable initiative to ensure the foregoing (including but not limited to obtaining a signed statement to support the application and/or consent by the individual for whom the charity/charitable initiative is set up).

e.       Applications will be considered on a case by case basis to ensure that the proposed charity/charitable initiative meet the member donation program’s goals.  For example, the application will be refused as not meeting member donation program’s goals if it is submitted on behalf of a political organization, a professional or semi-professional sports organization, or a government program (whether municipal, provincial or federal.

f. The Account must support a cause or activity that is inclusive and community facing, without prejudice. And that does not impose a particular doctrine or belief or the promotion of views which are in contravention of the Canadian Charter of Rights and Freedoms.

 

 

3.       Accounts and Responsibility:

 

a.       Each Account shall be designated by the Aeroplan Applicant as Public or Private. 

b.      Public Accounts.  Where the charity/charitable initiative have been designated as a “Public Account”, you are acknowledging and agreeing that:

  • Publicly viewed Accounts:

 

Will be accessible online at aeroplan.com/donate and can be shared with social networking sites such as Facebook, Twitter and such other sites as Aeroplan may determine from time to time (“Social Media Channel”).  Comments will be visible on aeroplan.com/donate and the applicable social network pages/accounts of the commenters, as well as on the applicable social network pages/accounts of the Applicant or charity/charitable initiative in question; 

 

  • information and comments about the charity/charitable initiative will be automatically placed on aeroplan.com/donate and on various social networking sites (subject to the user privacy settings on such social networking sites) and such sites will be open for commenting and public viewing;

 

  • The comment box plug in is provided by the applicable social networking site, and is governed by the terms and conditions and privacy policies of those sites.  Aeroplan has no responsibility or liability for the use of such social networking sites or plug-ins;

 

 

  • you will at all times be in compliance with applicable privacy laws including but not limited to the Canada’s Anti-Spam Legislation, SC 2010, c. 23, and any Regulations enacted thereunder; and 

 

c.       Private Accounts.  Where the charity/charitable initiative have been designated as a “Private Account”, you are acknowledging and agreeing that:

  • Privately viewed Accounts:

 

Will be accessible only through links to the Account that are sent to users via email by the Aeroplan Applicant or if applicable, the Account Administrator.  Please note however that Aeroplan cannot control and is not responsible for the forwarding/reforwarding of the Private Account link and as such, privacy cannot be guaranteed; and

 

  • if the Social Media Channel commenting feature is available and opted into by the Aeroplan Applicant, the terms and conditions of Section 3b shall apply;

 

  • you will at all times be in compliance with applicable privacy laws including but not limited to the Canada’s Anti-Spam Legislation, SC 2010, c. 23, and any Regulations enacted thereunder; and

 

 

  • Where you are the Aeroplan Applicant, you are solely responsible and liable for sending/forwarding/reforwarding the Private Account link. 

 

 

4.        Aeroplan will contribute an additional 10% top up to any miles donation on the website.

 

  1. Aeroplan would like to join our Members in supporting community initiatives that matter to them. Each charitable donation will be topped up by a 10% miles contribution from Aeroplan.  This is for all donations to all Accounts, all the time.

 

  1. Aeroplan's Rights: Without limiting the generality of Section 9a below, Aeroplan reserves the right to modify, suspend or cancel, in part or in its entirety at any time and without notice.

 

5.       Content:

 

a.       All content, including posted images, artwork, wording, comments, links to URLs, social media links and video content, is subject to approval by Aeroplan.  Aeroplan has the right but not the obligation to monitor, review and/or remove such content. Aeroplan assumes no responsibility or liability arising from our doing so or omission to do so.  Please note that except for the Facebook plug in, content on the Website is not provided by Facebook.  

b.      All materials with Aeroplan logos and Aeroplan mentions must be approved in writing by Aeroplan before they are publicly distributed / displayed by the charity/charitable initiatives. Such materials can be emailed to charitable.pooling@aimia.com for consideration.

 

6.       Accumulation/Donation of Miles:

 

a.       The Account is only able to accumulate Aeroplan Miles through donations from Members. 

b.      All transfers of donated Aeroplan Miles are made without charge.100% of all donations go directly into the member donation program account.

c.       A minimum donation of 1,000 Aeroplan Miles is required. 

d.       Once a donation transaction is completed by a Member, the transfer of the selected quantity of Aeroplan Miles to the designated charity/charitable initiative is final, and neither the choice of charity/charitable initiative selected nor the quantity of Miles donated may be reversed or modified.

e.       Tax receipts are not issued for donations of Aeroplan Miles.

 

7.       Redemption of Miles:

 

a.       Redemptions through the Account must be made in good faith and in accordance with the charitable purpose set out in the submitted application to Aeroplan.

b.      Miles redeemed using the secure passwords are not refundable.  It is the responsibility of each Aeroplan Applicant to safeguard access to and control the use of the secure password.   

 

8.       Closing/Expiry of Miles in Account:

 

a.       If the Aeroplan Applicant does not comply with these Charity Rules, the Account may be cancelled by Aeroplan, at its sole discretion and without further notice resulting in the automatic cancellation of the remaining Miles in the Account.

b.      Aeroplan reserves the right to investigate, and in its sole discretion, suspend and/or close any Account and cancel any reward or Miles, as the case may be, for any reasonable reason including for: misrepresentation, fraudulent activity, inappropriate content or promotion of views which are in contravention of the Canadian Charter of Rights and Freedoms. Aeroplan shall be the final authority on such determinations.

c.       All Mileage in an Account remains subject to Aeroplan’s Mileage expiry rules which can be found at http://www.aeroplan.com/terms_and_conditions.do including the fact that all accumulated Miles in the Account automatically expire, without notice, if the Account has not received a donation or redeemed Aeroplan Miles for a period of 12 consecutive months.

d.       It shall be the sole responsibility of the Aeroplan Applicant to ensure (and if an Account Administrator has been designated, cause the Account Administrator to ensure) that the Account is kept active and to monitor the expiry of Miles.

 

9.       Interpretation and Disclaimer.

 

a.       Aeroplan may in its sole discretion change, supplement, amend, suspend or terminate the member donation program and/or the Charity Rules from time to time, effective immediately.  The management and monitoring of the donation program and the Accounts shall be at Aeroplan’s sole discretion.

b.      Aeroplan shall be under no obligation to continue the member donation program or to provide any notice of its suspension or termination.

c.       Aeroplan will be the final authority as to the interpretation of these Charity Rules.

d.       In the event of conflict between the English and French versions of these Charity Rules, the English version shall prevail.

e.       Please note that Aeroplan is enabling an Aeroplan Miles pooling functionality through its Aeroplan member donation program. Aeroplan does not make any representation or warranty regarding the nature or trustworthiness of the charities that are part of the donation program and does not have any control or responsibility for how donated Miles are redeemed by the charities.  Without limiting the disclaimers of warranties and limitation of liability set out in the Aeroplan Rules or the Charity Rules, you agree that Aeroplan and any of its affiliates are not responsible for, and you release us and them from any and all liability arising as a result of, any accident, loss, injury or damage caused by the opening, management, use and/or closing of Accounts, the redemption of Miles through or donation of Miles to Accounts, this Website and/or any other matter related to the Aeroplan member donation program.

 

10.       Privacy:

 

a.       All personal information collected from the Aeroplan Applicant and/or Aeroplan Administrator shall be used by Aeroplan solely for the following purposes:

a.       ensuring the accuracy, validity and/or eligibility of the application and/or the charity/charitable initiative;

b.      opening, management and monitoring of the Account;

c.       the management of the member donation program;

d.       to understand Member and Applicant needs in order to develop and enhance the Member Donation Program; and

e.       to meet legal requirements.

b.      Please note that if the Account is a “Public Account”, the information listed above may be viewed by anyone having access to aeroplan.com/donate as well as to those who can access the social media sites linked to the Account.  The Social Media Channel commenting feature and all data collected or gathered by the feature are governed by the terms and conditions of the applicable Social Media Channel, including its applicable privacy policy.  By designating the Account as a “Public Account” there cannot be an expectation of privacy with respect to any information posted on the Charity’s/Charitable Initiative’s page. 

c.       Where the Social Media Channel commenting feature on the “Private Account” is available and has been opted into by the Aeroplan Applicant, there can similarly be no expectation of privacy in any comments made through that feature.  For example, all comments made on the Website can be posted to the commentator’s Facebook wall.  However, Aeroplan’s use of the information will be limited to the purposes set out above.

d.       The information provided in the Aeroplan Applicant’s application will not be shared with any of our third party partners; however, it may be shared with our processing suppliers for the purposes set out in 10a above.
